Terms and Conditions of Service

EFFECTIVE FROM 1 JULY 2017

  1. ACCEPTANCE OF TERMS AND CONDITIONS
      1. These Terms and Conditions of Service apply to all services carried out by Geraldton Transport.
      2. By accepting Geraldton Transport’s quotation and giving Geraldton Transport a shipment to collect, transport or deliver, or to perform such other services as requested, the customer accepts these Terms and Conditions for the shipment.
      3. These Terms and Conditions of Service apply unless and will prevail unless they are varied by Geraldton Transport in writing prior to their acceptance by the customer.
      4. Geraldton Transport will require each customer to complete a Customer Details form.  The customer must notify Geraldton Transport of any changes to their details.
  1. CONDITIONS OF CARRIAGE
      1. Geraldton Transport is not a common carrier and does not accept any liability as a common carrier and may refuse to transport goods or any class of goods for any reason.
      2. Geraldton Transport and the Customer acknowledge and agree that each of them have obligations under the Chain or Responsibility Law, and each must comply with those obligations.
      3. Geraldton Transport relies on the details supplied by the Customer, and does not accept responsibility for the accuracy or completeness of the information provided.
      4. When transporting any liquids or dangerous goods, the Customer must first advise Geraldton Transport of full description of the goods, and the dangerous goods must be packaged
  1. INSURANCE
      1. The Customer is responsible for effecting insurance in respect of the shipment for a value and upon such terms as the Customer chooses.
  1. LIABILITY
      1. Geraldton Transport will not be liable if they do not fulfil any obligations towards the customer as a result of:
      2. circumstances beyond Geraldton Transport’s control, including (but not limited to):
        1. Acts of God,
        2. force majeure;
        3. national or local disruptions in air or ground transportation networks and
        4. Mechanical problems to modes of transport or machinery;
        5. Latent defects or inherent vice in the contents of the shipment;
        6. Criminal acts of third parties such as theft and arson.
          1. the Customer’s acts or omissions or those of third parties such as (but not limited to) being in breach of their obligations under these terms and conditions
        1. Any right to damages against Geraldton Transport that does exist shall be extinguished unless action is brought within 6 months from the date of this contract or the date the services were completed, or the date the services should have been completed, whichever date occurs first
  1. INDEMNITY
      1. The Customer shall indemnify Geraldton Transport in respect of any claim, loss, damage, payment, fine, expense, duty, tax, impost or other outlay whatsoever or howsoever caused, whether arising directly or indirectly from any service arranged or performed by Geraldton Transport in respect of the shipment or in respect of any such cost incurred as a result of any breach of the terms, conditions or warranties in this contract by the Customer.
  2. PRICE
      1. Any quote for the services remains valid for 30 days from the date of the quote. 
      2. All charges and services applicable for the service will be in accordance with the quote.  Unless otherwise stated, GST and other applicable taxes shall be added to the quoted price.
      3. Geraldton Transport will give notice of changes to any fuel surcharge charged and the date for the implementation of any changes on our website at www.geraldtontransport.com
      4. Rates do not include insurance unless otherwise quoted.
      5. Any services provided using the Geraldton Transport Account for Toll Priority, TNT or Country Carriers will incur an additional Account Fee of $25.00 to cover administration costs.
    1. PAYMENT
      1. Invoices will be issued once the service has been completed.
      2. Full payment must be made within 14 days from the date of the invoice.
      3. If the customer wishes to contest an invoice, they must do so in writing within 14 days from the date of the invoice.
  1. LATE PAYMENT
    1. If the Customer fails to make full payment by the due date, Geraldton Transport may charge:
      1. An Administration Fee of $25.00 for an amount not paid within 14 days from the due date.
      2. A Debt Collection Fee of up to 35% plus GST on the outstanding amount for an amount not paid between 14 and 90 days from the due date.
      3. A Debt Collection Fee of up to 45% plus GST on the outstanding amount for an amount not paid over 90 days from the due date.
    2. Geraldton Transport may also charge interest on any overdue amount from the due date until the date of payment in full.  The amount of interest will be calculated daily and compounded monthly at the prime commercial lending rate charged by the ANZ Bank on the due date plus 4%.
